Accident circumstances

The incident occurred on the M1 after an accident happened ahead of Daniel. He stopped and exited his vehicle on the hard shoulder to provide assistance.

Untraced driver investigation and MIB claim

Following lengthy investigations and a PSNI report, it was confirmed that the at-fault driver was untraced. Anselm Henry progressed the claim through the Motor Insurers’ Bureau (MIB), which handles compensation where an uninsured or untraced driver cannot be pursued directly.

The MIB accepted the claim, allowing the matter to proceed to valuation and negotiation.

Daniel required medical assessment for both the physical injury to his leg and the psychological impact of the incident. Specialist evidence was obtained to ensure the long-term effects were properly reflected in the valuation of the claim.

Psychological assessment Assessment of trauma, anxiety and ongoing psychological symptoms following the near-miss incident.
Plastic surgery reports Two reports assessing leg scarring, cosmetic impact and any future treatment considerations.

Negotiation and settlement

Court proceedings were not issued. Following negotiations with the Motor Insurers’ Bureau, the claim settled for £120,000, reflecting the injury, scarring and the psychological impact of the incident on the M1 near Belfast.
